Terms of Service

By registering for any CSET Tutor Prep Class, you acknowledge that you have read and agree to be bound by the below Terms of Service, including the below Waiver of Liability and Hold Harmless Agreement.

Waiver of Liability and Hold Harmless Agreement

1. In consideration for receiving permission to participate in this/these Prep Class(es) and/or Private Tutoring sessions, you hereby release, waive, discharge and covenant not to sue CSET Tutor, Robert J. Duncan, his associates, affiliates, and/or the facility where this activity is held (hereinafter referred to as releasees) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any of the property belonging to you, whether caused by the negligence of the releasees or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

2. You further hereby agree to indemnify and hold harmless the releasees from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to your participation in said activity, whether caused by the negligence of releasees or otherwise.

3. It is your express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named releasees.  You hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California.

4. You warrant and assure that you are at least 18 years of age and fully competent.  You acknowledge that the above constitutes the whole of our waiver of liability and hold harmless agreement, and that no additional claims or representations have been made.

No Refund Policy

Please be aware that we have a No Refund Policy for all prep classes.  Refund requests, including those made by students who cannot attend, regardless of the student's reason(s), and regardless of whether the student provides us with advance notice, will not be honored.  Exceptions may be made only in cases in which a student cannot attend due to serious illness or the death of an immediate member of the student's family.  In these cases, official documentation may be required.

While we endeavor to provide the best CSET prep services possible, we do not guarantee that you will pass the exam.  Students who do not pass after attending one of our classes may, however, be eligible to take that class again free, subject to our Guarantee as presented on our CSET Prep Class webpage located at: http://csettutor.com/CSET_Prep_Class.htm and reprinted below.

Prep Class Guarantee

If you take our CSET Prep Class and don't pass the corresponding CSET Multiple Subjects Subtest, you can take that Prep Class again with no charge.  Offer is good for one additional session only and expires after 6 months.  Offer is not transferable and cannot be applied to other subtest classes.  The same admission materials, including receipt and photo ID, that were brought to your original session, must be brought to the second session in order to be admitted.  Offer applies to CSET Prep Classes only and does not apply to any of our other products or services.  Free class subject to availability and occupancy restrictions.  You must contact us in advance to schedule your class.  No "walk-ins" will be admitted.  We reserve the right to discontinue classes without notice.

Private Tutoring Satisfaction Guarantee

After attending your first Private Tutoring session, if you are not satisfied for any reason, you may cancel your remaining tutoring sessions and receive a refund for those sessions not yet attended.  Should you choose to cancel a prepaid Tutoring Package after attending your first session, the hours which you have attended will be billed/deducted at our current Hourly Rate (as listed on our website at http://csettutor.com/CSET_Tutoring_Packages.htm) and you will receive a refund for the remaining amount of the Tutoring Package price.

In order to receive a refund per this policy, you must notify us of your desire to cancel your remaining sessions within 3 business days of attending your first tutoring session or at least 24 hours prior to your second tutoring session, whichever is earlier.  Cancellation and refund requests submitted after this timeframe will not be honored.

This offer applies to Private Tutoring only and does not apply to any of our other products or services.  This offer shall not be construed to waive your obligation to pay for your first tutoring session in its entirety, regardless of whether you have attended the session in whole, in part or not at all.

Prep Class Rules and Etiquette

We reserve the right to remove any student who, in our sole judgment, does not comply with the below Prep Class Rules and Etiquette.  No refund will be given.

Prep Class Rules and Etiquette

  1. No laptops allowed.
  2. No recording devices allowed.
  3. No outside food or drinks allowed (except by instructor permission).
  4. Cell phones must be set on "silent" mode during class.
  5. No talking or side conversations during lectures.
  6. No other activities that could be considered disruptive to instructor or your fellow students.

Prep Class Cancellation

Though it is rare, we reserve the right to cancel prep classes due to insufficient enrollment.  If we should need to cancel a class in which you are enrolled, we will provide you with notification by email at least 3 days prior to your scheduled class date.  This notification will be sent to the email address which you used to register via PayPal.  It is your responsibility to ensure that your spam filters and email settings allow you to receive such emails from the domain "@csettutor.com".  CSET Tutor and all other releasees will not be held responsible should you fail to receive a cancellation notice due to email transmission or receiving problems of any kind.

In the event that a class is cancelled due to insufficient enrollment, you will be issued a full refund for that class within 3 business days of our cancellation notice.  You will not be issued a refund for additional classes or tutoring for which you may have registered if those classes or tutoring sessions have not been cancelled.  In lieu of a refund in the event of class cancellation, you may also elect to transfer your registration to another session of the same class so long as there is space available in the class to which you wish to transfer.  You must contact us by phone or email at least 2 business days prior to the class you wish to attend to verify availability and request this enrollment transfer.

Private Tutoring No-Show and Cancellation

If your tutor is unable to attend a Private Tutoring session, he/she may cancel/reschedule that session and will endeavor to give you at least 24 hours notice of cancellation, except where sudden illness or other emergency makes this not feasible.

Should you be unable to attend a Private Tutoring session due to illness or other emergency, we ask that you provide us with a minimum of 24 hours notice.  Should you fail to attend a scheduled session without prior notice and/or cancel less than 24 hours in advance, we may charge you for that session and/or count it against your package total.

Should you cancel more than two Private Tutoring sessions, we may refuse to accept additional cancellations, whether or not notice is given, and charge you for those additional cancelled sessions and/or count the cancelled sessions against your package total.

Privacy Policy

We respect your privacy and we will never sell your personal information to any third party.  Should we use your data for our own advertising purposes, such as through Google Advertising, we do so in compliance with industry privacy standards.
